Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and Hiribly ("Hiribly", "we", "us") and govern your access to and use of the Hiribly platform, including any websites, dashboards, APIs, and AI-assisted screening features (collectively, the "Service").

1. Eligibility & account

You must be at least 18 years old and authorised to bind any organisation on whose behalf you sign up. You are responsible for keeping your credentials secure and for all activity under your account.

2. Permitted use

You may use the Service to create job postings, receive candidate applications, and review AI-generated screening summaries to support your hiring decisions. You agree not to:

  • post roles that are fraudulent, misleading, or that you are not authorised to recruit for;
  • include criteria that unlawfully discriminate on the basis of race, colour, religion, sex, sexual orientation, gender identity, national origin, age, disability, genetic information, veteran status, or any other characteristic protected by applicable law;
  • solely automate hiring decisions in jurisdictions that prohibit fully automated employment decision-making (e.g. EU AI Act, NYC Local Law 144, Illinois AI Video Interview Act) — a qualified human must review every AI output before action;
  • upload candidate data you have no lawful basis to process;
  • scrape, reverse engineer, resell, or use the Service to build a competing product.

3. Your role as employer / data controller

For candidate personal data you upload or receive through the Service you act as the data controller (or business, under CCPA). Hiribly acts as your processor (service provider) and processes that data only on your documented instructions, as set out in our Data Processing Addendum.

4. AI-assisted screening

The Service uses third-party large language models to generate fit scores, strengths, concerns, and suggested interview questions. Outputs are probabilistic, may contain errors or bias, and must not be used as the sole basis for any hiring, rejection, or compensation decision. You are responsible for human review, for any required bias audits (e.g. NYC LL144), and for providing candidates with the AI disclosures required in their jurisdiction.

5. Fees, billing & cancellation

Paid plans are billed in advance via Stripe at the prices shown on our Pricing page. Subscriptions renew automatically until cancelled. You may cancel at any time from the billing settings; access continues through the end of the paid period. Fees are non-refundable except where required by law.

6. Customer content & ownership

You retain all rights in the content you submit (job posts, candidate data, etc.). You grant Hiribly a worldwide, non-exclusive licence to host, process, transmit, and display that content solely as needed to operate, secure, and improve the Service for you. We do not train third-party foundation models on your customer content.

7. Confidentiality & security

We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect customer content. No system is perfectly secure; you must use the Service in accordance with our security guidance and notify us promptly of any suspected compromise.

8. Suspension & termination

We may suspend or terminate access for non-payment, breach of these Terms, suspected unlawful use, or as required by law. You may terminate at any time by closing your workspace; we will delete or anonymise customer content in accordance with our Privacy Policy and DPA.

9. Disclaimers

EXCEPT AS EXPRESSLY STATED, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI OUTPUTS ARE ACCURATE, COMPLETE, OR FREE OF BIAS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA. EACH PARTY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE FEES PAID BY YOU TO HIRIBLY IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. NOTHING LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

11. Indemnity

You will defend and indemnify Hiribly against third-party claims arising from your job postings, your processing of candidate data, your hiring decisions, or your breach of these Terms.

12. Governing law & disputes

These Terms are governed by the laws applicable at Hiribly's principal place of business, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer protection law gives you the right to bring proceedings in your country of residence.

13. Changes

We may update these Terms; material changes will be notified by email or in-product, and continued use after the effective date constitutes acceptance. Archived versions are available on request.
